Border Czar Tom Homan has declared the initiation of a federal investigation into Representative Alexandria Ocasio-Cortez (D-NY) regarding allegations that she employed an undocumented immigrant on her staff and aided other illegal aliens in avoiding Immigration and Customs Enforcement (ICE) agents.
The Trump administration is probing Ocasio-Cortez for two purported offenses: employing an undocumented immigrant who later helped another person evade ICE. In a discussion with conservative podcaster Benny Johnson, Homan revealed that he has directed the agency to take legal action against her.
“This matter is under review (AOC employing illegal alien), I cannot comment further. I am aware of the situation, and we have requested ICE to focus on that case,” Homan stated. “Regarding her providing information on how to evade ICE arrests, she is essentially instructing them on how to avoid prosecution. There are laws in place that make it a crime to knowingly obstruct your removal.”
Johnson raised concerns about how an undocumented immigrant could have obtained employment in Congress and possibly access to classified information.
“It is not feasible,” Homan emphasized, asserting that the congresswoman will face consequences if these allegations are substantiated.
In March, Diego de la Vega voluntarily departed the U.S. amid heightened deportation efforts by the Trump administration, citing safety concerns, as reported by TownHall.com. He became politically engaged in 2010 when he advocated for the DREAM Act, legislation aimed at establishing a pathway to legal status for undocumented immigrants who were brought to the country as children.
Although the bill narrowly failed in the Senate by a margin of five votes, de la Vega, despite his undocumented status, served as a “special assistant” to former Harlem Assemblymember Robert J. Rodriguez and interned for Representative Carolyn Maloney (D), according to the report.
In 2022, de la Vega was appointed as the Deputy Communications Director by Ocasio-Cortez. In an interview with Migrant Insider, AOC commended him, stating, “Diego is amazing.”
In February, Homan sent a correspondence to the deputy attorney general seeking an investigation into Ocasio-Cortez. This request followed shortly after reports surfaced indicating that the New York Democrat was conducting seminars aimed at teaching undocumented immigrants how to evade ICE enforcement.
Subsequent to Homan’s email to the DOJ, AOC disclosed that the Trump administration had not yet responded to her inquiries regarding whether she is under federal investigation.
“I’ve asked them, but they haven’t replied to me,” Ocasio-Cortez informed Fox News early last month. “However, I was once again fully exercising the First Amendment to educate people about their constitutional rights. They make numerous claims, but I have submitted a formal letter, and they refuse to respond.”
When questioned about the possible repercussions, she was candid. She asserted that detaining an elected official “without any legitimate grounds” would signify a “significant shift and escalation in what this administration is prepared to do to manipulate laws, norms, and the functioning of a normal democracy.”
“I sincerely hope that amidst all the saber-rattling this administration is engaging in, they genuinely consider the global implications of what it signifies for the United States,” Ocasio-Cortez remarked.
Earlier this year, the congresswoman facilitated a “Know Your Rights” webinar, where legal professionals provided guidance to undocumented immigrants on how to handle encounters with US Immigration and Customs Enforcement (ICE) authorities.
The online forum, conducted in both English and Spanish, offered legal guidance and disseminated documents, including one stating that immigrants “are not obligated to open the door” for ICE agents unless they possess a warrant signed by a judge.
Ocasio-Cortez’s office additionally provided details on obtaining pro bono legal support and encouraged undocumented individuals to complete privacy release forms, enabling her office to intervene in deportation cases.
Ocasio-Cortez has strongly refuted any claims that her conduct was improper, describing the possibility of a federal investigation as “politically motivated.”
